- "Service" refers to any residential, short-stay, or programme arrangement offered by Sampan Cove
- "Resident" refers to an individual receiving residential care at Sampan Cove
- "Family Representative" refers to the authorised family member or contact who engages with Sampan Cove on a resident's behalf
- "Agreement" refers to any service agreement entered into between Sampan Cove and a Resident or Family Representative
- "Website" refers to the Sampan Cove website at https://sampancove.live
2. Acceptance of Terms
By using our website, submitting an enquiry, or signing a service agreement, you confirm that:
- You are 18 years of age or older, or are acting on behalf of someone aged 18 or over
- You have the capacity to enter into a binding agreement
- You accept these Terms and Conditions in full
3. Service Description
Sampan Cove provides non-medical residential care services for older adults, including:
- Harbour Cove Residence: Full monthly residential stay at HK$13,100 per month
- Harbour Walk and Talk: Three-morning weekly programme at HK$1,750 per month
- Midweek Three-Day Stay: Tuesday-to-Thursday short stay at HK$2,200 per booking
Sampan Cove does not provide medical, nursing, or clinical care. Services are subject to availability. We reserve the right to decline an enquiry if the individual's needs fall outside the scope of non-medical residential support.
4. User Responsibilities
When using our website or engaging with our services, you agree to:
- Provide accurate and complete information in all enquiries and agreements
- Notify us promptly of any changes to a resident's health or circumstances that may affect their suitability for our services
- Treat staff, other residents, and programme participants with consideration and respect
- Comply with house rules communicated at the time of intake
- Not use our website for any unlawful purpose
5. Prohibited Activities
When using our website, you must not:
- Submit false or misleading information
- Attempt to gain unauthorised access to our systems or data
- Reproduce, copy, or redistribute website content without written permission
- Engage in any activity that disrupts or interferes with our website or services
6. Intellectual Property
All content on the Sampan Cove website, including text, images, and design, is the property of Sampan Cove or its licensors. You are granted a limited, non-transferable licence to view and use the website for personal, non-commercial purposes only. Reproduction or redistribution without written consent is not permitted.
7. Payment Terms
Fees are payable in Hong Kong Dollars (HKD). The following terms apply:
- Harbour Cove Residence: Monthly fee of HK$13,100, payable in advance at the start of each month
- Harbour Walk and Talk: Monthly fee of HK$1,750, payable at the start of the programme month
- Midweek Three-Day Stay: HK$2,200 per three-day booking, payable prior to arrival
- Accepted payment methods will be confirmed at the time of agreement
Refund policy for residential stays: Notice of one calendar month is required before vacating the residential place. Fees paid in advance for cancelled midweek stays may be refunded at our discretion, subject to at least five working days' notice of cancellation.
8. Service-Specific Terms
Residential stays: Sampan Cove provides residential support, meals, housekeeping, laundry, and access to activities as described. Medical care is not included. Families are responsible for arranging any external clinical or specialist support.
Walk and Talk programme: Participation assumes the individual is mobile enough to walk at a gentle pace without clinical support. Sessions are subject to weather conditions and minimum participant numbers.
Midweek stays: Short stays are subject to room availability and must be booked in advance. The minimum booking is one full three-day period (Tuesday to Thursday).
9. Disclaimers
Our website and services are provided in good faith. We do not represent that any particular outcome will result from participation in our services. Sampan Cove does not provide medical diagnosis, treatment, or clinical advice. Website content is for general information only and does not constitute professional advice of any kind.
10. Limitation of Liability
To the fullest extent permitted by Hong Kong law, Sampan Cove's liability for any claim arising out of the use of our website or services is limited to the amount paid for the service in question. We are not liable for indirect, consequential, or special damages. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.
11. Termination
Either party may terminate a service arrangement with one calendar month's written notice. Sampan Cove may terminate an arrangement with shorter notice where a resident's needs have changed beyond our capacity, where conduct is harmful to staff or other residents, or where payment obligations are not met. On termination, outstanding fees remain payable.
12. Dispute Resolution
These Terms and Conditions are governed by the laws of the Hong Kong Special Administrative Region. In the event of a dispute, we encourage resolution through direct communication in the first instance. If a resolution cannot be reached informally, disputes will be subject to the jurisdiction of the courts of Hong Kong SAR.
13. General Provisions
- Entire agreement: These terms, together with any signed service agreement, constitute the full agreement between us
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full effect
- Waiver: Failure to enforce any provision does not constitute a waiver of our rights
- Notices: Formal notices should be sent in writing to our address or email address below
14. Changes to These Terms
We may update these Terms and Conditions from time to time. The updated version will be published on this page. Continued use of our website or services after changes are published constitutes acceptance of the revised terms.
